A listing cannot go active without a photo. Under Stellar MLS Article 04.05(A), at least one front exterior photo, rendering, aerial photo, or water view from the property must be loaded before the listing activates. New listings enter Incomplete status automatically and are purged 30 days from entry if no photo is added, per Article 05.01. Vacant land is the only exception, and it still requires a photo, aerial, rendering, site plot, or plat map in the first slot.
Your yard sign cannot appear in the front exterior photo. Article 04.05(C) requires the front exterior photo to show a majority of the home or building, with the broker’s yard signage not visible. This is the single most common violation, and it triggers a Level I automatic fine of $100 on first offense.
No logos, agent photos, or contact information in any image. Article 04.05(D) prohibits company or agent logos, agent photos, commissions, bonuses, and contact information in listing images, with the Stellar MLS watermark as the only exception.
Editing has a hard line, and it sits at “material.” Stellar MLS photo guidance permits brightening underexposed interiors, altering removable furnishings, and adding non-permanent exterior items. It prohibits removing utility lines, adding landscape plantings, swapping or removing permanent fixtures, changing paint colors, and covering material flaws. Lifestyle photos and virtual tours featuring people, including people in costume, are not allowed. A pool cannot be labeled as a water view.
You need to own or license the photos. Ask your photographer, in writing, what your license covers and how long it lasts. State: Florida restricts what the camera may record. Florida Statute 934.50 prohibits using a drone with an imaging device to record privately owned property, or people on it, with the intent to conduct surveillance in violation of a reasonable expectation of privacy, absent written consent. The statute’s exceptions cover aerial mapping in compliance with FAA regulations, property appraisers assessing for ad valorem taxation, and certain utility operations. There is no blanket exception for a certificated commercial operator.
